1. Acceptance of Terms
By accessing or using RustToRoad ("we," "us," "our," the "Platform"), you agree to be bound by these Terms of Service. If you don't agree, don't use the Platform.
RustToRoad is operated by RustToRoad at rusttoroad.com. These terms apply to all visitors, registered users, and anyone who lists, buys, or otherwise interacts with content on the Platform.
2. Platform Usage
RustToRoad is a marketplace and resource platform for classic and project car enthusiasts. You may use the Platform to:
- Browse and search classic car listings
- Post car listings for sale
- Read and engage with repair guides
- Leave comments on repair guides
- Browse parts and upgrade recommendations
You agree not to use the Platform for any unlawful purpose, to post fraudulent listings, to harass other users, or to attempt to circumvent any security or access controls.
We reserve the right to remove any content or user account that violates these terms or that we determine, in our sole discretion, is harmful to the Platform or its community.
3. User Accounts
To post listings or comment on guides, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must provide accurate information when creating your account. You may not create accounts for others without their permission, impersonate any person or entity, or create multiple accounts to circumvent restrictions.
You must be at least 18 years old to use the Platform and create a seller account.
4. User-Submitted Content
Car Listings: When you submit a car listing, you represent that you have the right to sell the vehicle described, and that all information provided (description, price, condition, photos) is accurate to the best of your knowledge.
Photos: You retain ownership of photos you upload. By uploading photos, you grant RustToRoad a non-exclusive, royalty-free license to display those photos on the Platform in connection with your listing.
Comments: You are solely responsible for comments you post on repair guides. Comments must not be defamatory, harassing, spam, or violate any third-party rights.
We may remove any user-submitted content at any time without notice if we determine it violates these terms or is otherwise inappropriate.
5. Featured Listing Payments
RustToRoad offers paid "Featured Listing" upgrades that display your listing prominently at the top of search results. Pricing tiers:
- 7 Days: $4.99
- 14 Days: $9.99
- 30 Days: $14.99
Auto-Renewal: Featured listings may optionally auto-renew at the end of their term at the same rate. You will be charged automatically unless you cancel auto-renewal before the renewal date.
Cancellation: You may cancel auto-renewal at any time from your listing management page. Cancellation takes effect at the end of the current paid period — no refunds are issued for the remaining time on a featured period.
No Refunds: Featured listing fees are non-refundable once the listing has been activated and displayed on the Platform.
All payments are processed securely by Stripe. RustToRoad does not store your payment card information.
6. Premium Membership
RustToRoad offers a Premium Membership at $12/month that provides enhanced platform features.
Billing: Membership fees are billed monthly to the payment method on file. Your subscription renews automatically each month.
Cancellation: You may cancel your membership at any time. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the period you've paid for.
Refunds: Monthly membership fees are non-refundable except as required by applicable law.
Price Changes: We may change the membership price with 30 days' advance notice. Continued use after the price change takes effect constitutes acceptance of the new price.
7. Affiliate Links Disclosure
Specifically, RustToRoad participates in:
- Amazon Associates Program: Links tagged with
rusttoroad-20are Amazon affiliate links. - eBay Partner Network (EPN): eBay listings displayed on RustToRoad are sourced via the eBay Partner Network and include affiliate tracking parameters.
Affiliate revenue helps us maintain the Platform and create free repair guides. Our editorial recommendations are not influenced by affiliate relationships — we only link to products and parts that we genuinely believe are useful.
We track affiliate link clicks for attribution and analytics purposes.
8. Repair Guides — Limitation of Liability
Working on vehicles involves serious risks including personal injury, death, and property damage. Before attempting any repair or modification described on this Platform:
- Consult a qualified mechanic or automotive professional
- Follow all applicable safety guidelines and local regulations
- Ensure you have the proper tools, knowledge, and safety equipment
RustToRoad makes no warranties, express or implied, about the accuracy, completeness, or fitness for any particular purpose of repair guide content. RustToRoad is not liable for any injury, damage, or loss resulting from following repair guide instructions.
9. Marketplace Transactions
RustToRoad is a listing platform, not a party to any transaction between buyers and sellers. We do not verify the accuracy of listing information, inspect vehicles, or guarantee any transaction.
Buyers and sellers are solely responsible for conducting their own due diligence, negotiating terms, and completing any transaction safely. We strongly recommend meeting in a public place, having a mechanic inspect any vehicle before purchase, and following standard safe trading practices.
RustToRoad is not liable for any disputes, losses, or damages arising from transactions between users.
10. Intellectual Property
All Platform content not submitted by users — including design, text, graphics, software, and the RustToRoad name and logo — is owned by or licensed to RustToRoad and protected by applicable intellectual property laws.
You may not reproduce, distribute, or create derivative works from our content without express written permission.
11. Account Termination
We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms of Service.
You may delete your account at any time by contacting us at hello@rusttoroad.com. Upon deletion, your listings will be removed from the Platform. Active featured listing fees already paid are non-refundable.
We may retain certain data after account deletion as required by law or for legitimate business purposes (fraud prevention, dispute resolution).
12. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, RUSTTOROAD DISCLAIMS ALL WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUSTTOROAD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.
IN NO EVENT SHALL RUSTTOROAD'S TOTAL LIABILITY EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO RUSTTOROAD IN THE 12 MONTHS PRECEDING THE CLAIM.
14. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration rather than in court, except for claims that may be brought in small claims court.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Platform. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
